Terms of Service
Please read these terms carefully before using our services. They outline the agreement between you and Big Bear Movers.
Effective Date: January 1, 2024 | Last Updated: January 1, 2024
Welcome to Big Bear Movers. These Terms of Service ("Terms") govern your use of our moving services and website. By engaging our services, you agree to be bound by these Terms.
We are committed to providing transparent, fair, and professional moving services. These Terms are designed to protect both you and Big Bear Movers while ensuring a smooth moving experience.
Service Agreement
Acceptance of Terms
By booking our moving services or using our website, you agree to these Terms of Service. If you are booking on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.
Service Description
Big Bear Movers provides professional moving services including residential moves, commercial relocations, packing services, and storage solutions. The specific services provided will be outlined in your service agreement or quote.
Booking and Confirmation
A booking is confirmed only after we receive your signed agreement and any required deposit. We reserve the right to refuse service to anyone for any lawful reason. All bookings are subject to availability.
Service Modifications
Any changes to your moving date, services, or inventory must be communicated at least 48 hours before your scheduled move. Changes may result in price adjustments based on the revised scope of work.
Pricing and Payment
Estimates and Quotes
Estimates are based on the information you provide. Binding estimates guarantee the price for the services and inventory listed. Non-binding estimates may change based on actual services provided and time required.
Payment Terms
Payment is due upon completion of services unless other arrangements have been made. We accept cash, check, and major credit cards. Commercial accounts may be eligible for net payment terms with approved credit.
Additional Charges
Additional charges may apply for: extra stops, long carries (over 75 feet), stairs, elevators, oversized items, packing materials, and services not included in the original estimate. These will be communicated before the work is performed.
Cancellation Policy
Cancellations made less than 24 hours before the scheduled move may incur a cancellation fee of up to 25% of the estimated cost. Deposits are non-refundable for cancellations made within 48 hours of the move date.
Customer Responsibilities
Accurate Information
You must provide accurate and complete information about items to be moved, access conditions at both locations, and any special requirements. Failure to disclose relevant information may result in additional charges or service delays.
Preparation
Unless we are providing packing services, all items must be properly packed and ready for transport. Fragile items should be clearly marked. You are responsible for disconnecting appliances and electronics unless otherwise arranged.
Prohibited Items
We cannot transport hazardous materials, perishables, plants, pets, or items of extraordinary value (jewelry, cash, important documents) unless specifically agreed upon. You must remove these items before the move.
Access and Permits
You are responsible for ensuring legal access to both locations, obtaining necessary parking permits, and reserving elevators if required. Any fines or fees resulting from lack of proper access are your responsibility.
Liability and Insurance
Basic Liability Coverage
We provide basic liability coverage at $0.60 per pound per item at no additional charge. This coverage is limited and may not reflect the full value of your items.
Full Value Protection
Optional full value protection is available for an additional fee. This provides coverage for the replacement value or repair of damaged items, subject to deductibles and coverage limits outlined in the protection plan.
Claims Process
Any damage or loss must be noted on the delivery receipt at the time of delivery. Written claims must be filed within 9 months of delivery. We will investigate all claims promptly and fairly.
Limitations of Liability
We are not liable for damage caused by: acts of God, war, government actions, strikes, or circumstances beyond our control. We are not responsible for mechanical or electronic malfunctions of items unless caused by our negligence.
Storage Services
Storage Terms
Storage services are subject to separate storage agreements. Monthly storage fees are due in advance. We reserve the right to auction or dispose of items for unpaid storage fees after proper legal notice.
Access to Stored Items
Access to stored items requires advance notice and may be subject to access fees. Items in storage are subject to the same liability limitations as items being moved.
Storage Insurance
While we maintain secure, climate-controlled facilities, we strongly recommend purchasing storage insurance for valuable items. Our basic liability coverage applies to stored items.
Dispute Resolution
Good Faith Resolution
We commit to working with you in good faith to resolve any disputes or concerns. Please contact our customer service team first to attempt to resolve any issues.
Arbitration
Any disputes that cannot be resolved through good faith negotiation shall be subject to binding arbitration in accordance with the rules of the American Arbitration Association.
Governing Law
These terms are governed by the laws of Massachusetts. Any legal proceedings must be brought in the courts of Massachusetts.
Time Limitations
Any legal action related to our services must be brought within one year of the date of service. This limitation applies to all claims including negligence, breach of contract, and property damage.
General Provisions
Entire Agreement
These terms, along with your signed service agreement, constitute the entire agreement between you and Big Bear Movers. Any modifications must be in writing and signed by both parties.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Assignment
We may assign or subcontract our obligations under these terms. You may not assign your rights or obligations without our written consent.
Force Majeure
We are not liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or government actions.
Interstate Moving Notice
For interstate moves, additional federal regulations apply. You will receive a copy of "Your Rights and Responsibilities When You Move" booklet and additional documentation as required by the Federal Motor Carrier Safety Administration (FMCSA). Interstate moves are also subject to federal tariff regulations.
